At the end of its 2022 term, the US Supreme Court issued its much-anticipated ruling in Ruan v. United States. The Court ruled that to convict a physician for criminal violations of the federal Controlled Substances Act (CSA), the government must prove beyond a reasonable doubt that the physician knowingly or intentionally acted in a manner that was not “authorized” by their license. The Supreme Court’s ruling in Ruan may have ramifications for providers and for prosecutions of other types of alleged criminal conduct in healthcare, as well as for some civil enforcement actions.
