Tony Shaw is a partner in the Litigation Practice Group and co-leader of the CMBS & creditors’ rights team. He primarily represents banks and private lenders.
For more than 15 years, Tony has represented a variety of businesses — from manufacturers and insurers to financial institutions — in workouts, litigation, trials, and arbitration.
Tony has extensive litigation experience in bankruptcy and creditor rights matters and has argued and tried several dozen cases to verdict before bench and jury in courts throughout the United States. He currently represents the Chapter 7 trustee in In re: Atherotech, Inc., one of the largest bankruptcy cases ever filed in the state of Alabama.
Tony handles a wide range of bankruptcy and creditor rights matters, including workouts, fraudulent conveyance actions, alter-ego claims, corporate veil piercing, and post-judgment collections. He is licensed and regularly represents clients in state and federal courts in Alabama, Florida, Georgia, Mississippi, Tennessee, New York, and Texas. Tony has assisted clients with the recovery of several hundred million dollars in assets. He has obtained several six-figure, seven-figure, and eight-figure judgments or settlements for creditors throughout the country. He routinely counsels clients concerning workouts and loan restructuring, and advises creditors in Chapter 7, 11, and 13 bankruptcy proceedings regarding preference actions, administrative expenses, executory contracts, and the automatic stay.
In addition to his litigation and restructuring practice, Tony has an extensive appellate practice. He has represented clients before the US Court of Appeals for the Eleventh Circuit, bankruptcy court appeals to district courts and the Alabama Supreme Court, Georgia Supreme Court, Mississippi Supreme Court, Alabama Court of Civil Appeals, Court of Appeals of Georgia, and all Florida district courts of appeals.
Tony also has extensive experience involving the Perishable Agricultural Commodities Act (PACA) and its effects on produce debtors and produce creditors. In addition, he is a published author in a national journal and has been interviewed and quoted on the subject by Al.com.
Tony speaks frequently on bankruptcy and creditor rights issues.
